Led by the dynamic duo of Sushant and Vijaya, we are here to help your brand's world and make sure it's protected like never before! Top Tips for Naming a Product Brand for Trademark in India.
✔️ Make It Distinctive and Unique
Avoid common terms or descriptive phrases like "Good Soap" or "Healthy Water".
The name should stand out and not describe the product directly.
✔️ Easy to Spell, Pronounce & Remember
Simplicity leads to better brand recall.
Eg: Zara, Colgate, Nykaa — short, sharp, sticky.
✔️ Inventive Words Have Highest Trademark Strength
Coined/fanciful words like Kodak, Zomato, Pepsi are the easiest to protect legally.
✔️ Avoid Generic or Common Descriptions
Words like "Milk", "Pure", "Fresh", or "Gold" are hard to trademark alone.
✔️ Conduct Trademark Public Search (TM Search India)
Use https://ipindiaonline.gov.in/tmrpublicsearch/
Check if similar or identical names already exist in your product class (Nice Classification).
✔️ Domain + Social Handle Availability
Ensure the .com, .in, and social usernames are also available and brandable.
✔️ Avoid Religious, National, or Prohibited Words
Names like "Gandhi", "India", "President", "Flag", etc., are not allowed under TM rules.
✔️ Keep it Category-Neutral (if scalable)
A name like “Forestiva” can grow into cosmetics, foods, supplements — while “HerbalShampoo24” cannot.
✔️ Use Numerology or Astrology (Optional)
Many Indian brands use Chaldean numerology or vastu principles for name vibrations and energy.
✔️ File Under Correct Class (Nice Classification)
For example:
Class 3 = Cosmetics, Soaps
Class 5 = Pharmaceuticals, Supplements
Class 25 = Clothing, Apparel
Class 35 = Advertising, Online Retail
You may file under multiple classes if needed.

Class 25 – Clothing
Class 35 – Advertising/Business services
3. Trademark Public Search
Conduct a TM Search at the official trademark website:
Ensure there are no identical or deceptively similar marks in the same class.
4. Prepare Application Documents
Details required:

Type of applicant (individual/startup/SME/company)
Brand name/logo (wordmark, device mark, sound mark)
Power of attorney (if filed by agent)
Business description
Class of trademark
5. File Trademark Application (Form TM-A)
You can file:
Online via https://ipindia.gov.in/
Or physically at any of the Trademark Registry Offices in India
Fees:

It may be:

8. Show Cause Hearing (if needed)
If objections are raised and reply isn’t accepted, a hearing is scheduled.
You or your agent may attend (online or in person) to defend the mark.
9. Trademark Publication in Trademark Journal
Once accepted, the mark is published in the Official Trademark Journal for public opposition.
This stage lasts 4 months.
If no opposition is received, it proceeds to registration.
10. Opposition (Optional Stage)
If any third party opposes within 4 months:
A legal battle begins: notice, counter-statement, evidence, hearing.
11. Trademark Registration Certificate Issued
If no opposition or opposition is cleared, the Registrar issues the:
Registration Certificate (Form TM-R)
Valid for 10 years from application date
12. Use ® Symbol
